Terms of Service

01The short version

This site sells digital products, primarily Claude Code skills packages and templates. It also supports consulting, audits, client portals, reports, and related services. When you buy a product, you get a license to use it. When you hire me for services, the written scope or proposal controls the work. If something is broken, email me and I’ll work on a practical fix.

02Who you are agreeing with

These terms are between you and Michael Dishmon, a sole proprietor based in the USA. By using this site, creating an account, or purchasing a product, you agree to these terms. If you don’t agree, that’s completely fine, but please don’t use the site.

You must be at least 16 years old to use this site, create an account, or purchase products. By using this site you represent that you meet this age requirement. If you are under 16, please do not use this site or submit any personal information.

03Accounts

You can browse the site without an account. To purchase products or access downloads, you’ll need one. You’re responsible for keeping your login credentials secure. If you think someone has accessed your account without permission, email me immediately at berserk@michaeldishmon.com.

I reserve the right to suspend or terminate accounts that violate these terms. If that happens, I’ll tell you why.

04Products, purchases, and services

Products sold on this site are digital goods, including Claude Code skills packages, templates, and related tooling. All prices are listed in USD and include applicable descriptions of what you’re getting.

Payments are processed by Stripe. When you complete a purchase, you receive a license to use the product for your own work (personal or commercial, depending on the product’s specific license terms).

Consulting, audit, implementation, and client portal work may be governed by a proposal, statement of work, invoice, email approval, or other written scope. If there is a conflict between these site terms and a signed agreement, the signed agreement controls for that engagement.

05Refund policy

Because these are digital products that are delivered immediately upon purchase, all sales are final once access to the product has been granted. If a product is genuinely defective or doesn’t match its description, email me and I’ll make it right, either with a fix, a replacement, or a refund.

I’d rather you be happy with what you bought than fight about a refund. If something isn’t working for you, just reach out.

06License and usage rights

When you purchase a product, you receive a non-exclusive, non-transferable license to use it. What that means in practice:

Use the product in your own projects (personal or commercial)

Modify the product for your own use

Use it across multiple projects you personally work on

Resell, redistribute, or share the product files with others

Include the product in a competing product or template marketplace

Claim authorship of the original product

Use purchased content - including skill files, templates, prompts, or accompanying documentation - to train, fine-tune, or build commercially-distributed AI models, or to build competing skill or template marketplace products. You may use purchased content in your own internal or private AI pipelines and for commercial use within your own business.

To be specific on AI training: the products sold here are licensed for your personal and commercial use in your own work. Direct inclusion of these files in a training dataset, or using outputs generated with them as synthetic training data for a commercially-distributed model or a competing marketplace product, requires a separate license. Email me if you want to talk about it.

07Intellectual property

The content on this site, including text, designs, code, and product files, is owned by Michael Dishmon unless otherwise noted. Your purchase gives you a license to use specific products. It does not transfer ownership of the underlying intellectual property.

If you create something using a purchased product as a starting point, the thing you create is yours. The original product files remain mine.

08Limitation of liability

I do my best to make sure everything on this site works correctly. That said, this is a one-person operation and things can break. The site and products are provided “as is.” To the maximum extent permitted by applicable law, I’m not liable for indirect, incidental, or consequential damages arising from your use of the site or any products purchased here.

My total liability for any claim is limited to the amount you paid for the product or service giving rise to the claim, or one hundred dollars, whichever is greater, to the maximum extent permitted by applicable law. If something goes wrong, I’ll work with you to find a reasonable solution.

Nothing in this agreement limits or excludes liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded by applicable law.

09Availability and uptime

I aim to keep the site running, but I can’t guarantee 100% uptime. Maintenance, hosting issues, or acts of nature can cause temporary interruptions. If your account or downloads are affected by extended downtime, email me and I’ll make sure you can access what you paid for.

10Governing law

These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict of laws principles. Any disputes arising under these terms will be resolved in the state or federal courts located in Oregon. I’d much rather resolve things over email than in a courtroom, so please reach out first.

11Changes to these terms

I may update these terms from time to time. When I do, I’ll update the date at the top. For significant changes that affect your rights as a customer, I’ll do my best to notify you via email if you have an account. Continued use of the site after changes are posted means you accept the updated terms.

12AI assistant

This site has a chat assistant powered by an external large language model. A few things to know before you use it.

Do not submit personal, confidential, or sensitive information through the chat. That includes anything covered by HIPAA, PCI, attorney-client privilege, or similar regulated categories. The assistant is for general questions about my work; it is not a secure channel for anything else.

Responses are generated by a model and can be wrong. The assistant is not legal, medical, financial, or any other kind of professional advice. Verify anything important before acting on it.

I rate-limit the chat to prevent abuse. If you hit the limit, wait a bit or email me directly. Attempts to extract the system prompt, jailbreak the assistant, or use it to attack other services are not permitted and may be rejected at the request level.

13Client portal and reports

Some clients receive access to a private portal, report pages, files, messages, invoices, meetings, and AI-assisted report chat. Access is tied to the client account or engagement. You are responsible for keeping your login credentials secure and for telling me when a team member should be removed.

Reports, audits, dashboards, and recommendations are provided for business decision support. They are based on the information available at the time, the systems connected, and the scope of the engagement. You remain responsible for final business, legal, financial, advertising, compliance, and technical decisions.

14Acceptable use

You agree to use the site, portal, downloads, and AI features in a lawful and reasonable way. Do not try to bypass access controls, scrape private portal content, overload the service, upload malware, probe systems without permission, or use the AI assistant to attack other services.

Sensitive data should be handled through a written engagement scope that says exactly what is being processed. Avoid submitting payment card numbers, medical records, government IDs, privileged legal material, or other regulated sensitive data through ordinary site forms or chat.

15Privacy, cookies, and security

Data handling is explained in the Privacy Policy. Optional tracking is explained in the Cookie Policy. Security practices and disclosure steps are summarized on the Security page.
